1. ACCEPTANCE OF TERMS
By using PasaBar ("the App"), you agree to be bound by these Terms of Service. If you do not agree, do not use the App.
- Updates: When these Terms are updated, continued use of the App constitutes acceptance of the new Terms, regardless of whether you formally acknowledge the notification.
- Electronic Contract: Acceptance via checkbox at registration constitutes a valid electronic contract under Section 7 of Republic Act No. 8792 (Electronic Commerce Act of 2000).
- Security: Your data is stored on secure servers with industry-standard encryption. You can request deletion of your data at any time from your account.
2. DESCRIPTION OF SERVICE
The App provides AI-assisted Philippine Bar Examination review tools, including interactive study heatmaps, practice questions with AI-generated feedback, and progress tracking across all bar exam subjects. It is designed as a study aid and bar review supplement.
Some features, including the Criminal Law Exam Radar in full, are accessible without an account. Other subjects and features require registration and/or an active subscription as described on our subscription page.
3. USER RESPONSIBILITIES
You agree to:
- Use the App for lawful purposes only.
- Not rely solely on AI-generated content for legal matters.
- Verify all information against official sources (Supreme Court E-Library, Official Gazette, SCRA, etc.).
- Not share or redistribute App content as official legal documents.
- Maintain one account per person. Creating multiple accounts to circumvent access restrictions or pricing is a material breach.
- Not share your Google account or PasaBar session with any other person.
- Not include sensitive personal information (e.g., client names, identification numbers) in quiz answers, as answer text may be transmitted to third-party AI services for processing.
- Consult official review materials and a qualified lawyer for practice or litigation matters.
4. INTELLECTUAL PROPERTY
- Our Rights: The App, its design, source code, data structures, topic classifications, and all original editorial content are owned by PasaBarPH and are protected under the Intellectual Property Code of the Philippines (R.A. 8293).
- Bar Exam Questions: Questions used in the App are sourced from official Philippine Bar Examinations conducted by the Supreme Court. These are part of the public record. PasaBar does not claim ownership over bar exam question text. If the Supreme Court or its authorized representative requires us to remove any content, we will comply promptly.
- Your License: PasaBar grants you a limited, personal, non-exclusive, non-transferable license to access and use the App for your own personal bar review preparation.
- Prohibited Uses: You must not — without prior written consent — reproduce, copy, redistribute, sell, or resell any App content; screen-record or scrape the platform for redistribution; use automated bots or scripts to extract data; reverse-engineer any part of the App; or use App content to create competing products or services.
5. DATA PRIVACY
- Compliance: We operate subject to Republic Act No. 10173 (Data Privacy Act of 2012). We do not sell or share user data with third parties for marketing purposes.
- Storage: Your data is stored on secure servers with industry-standard encryption.
- Anonymous users: No personal data is collected or stored on our servers. Study progress is kept in browser storage on your device only.
- Payments: Payment credentials are never processed by PasaBar. All credential handling is done by our payment processor under applicable BSP and PCI-DSS standards.
- Rights: You have the right to access, correct, and delete your personal data. Full details are in our Privacy Policy.
6. PAID SERVICES: SUBSCRIPTIONS
6.1 Subscription Plans
Some features of the App are available only with a paid subscription. Available plans, pricing, and included features are described on our subscription page at the time of purchase.
- The Criminal Law Exam Radar is fully accessible to all users, including those without an account or subscription.
- All other subjects and premium features require an active subscription.
- Access levels are enforced server-side on every request.
6.2 No Automatic Renewal
PasaBar subscriptions do NOT auto-renew. Your access expires at the end of your subscription period unless you manually purchase a new subscription. We may send a courtesy reminder before expiry, but we are not obligated to do so.
6.3 Stacking
If you purchase a subscription while a previous subscription of the same type is still active, the new period is added to your remaining balance — subscriptions stack rather than replace.
6.4 Pricing and Taxes
All prices are in Philippine Pesos (₱) and are inclusive of applicable taxes. Prices are subject to change with at least fourteen (14) days' advance notice. Changes do not affect active subscriptions already purchased.
6.5 Payment Processing
Payments are processed through PayMongo Philippines, Inc. via GCash. By purchasing a subscription, you also agree to PayMongo's Terms of Service and GCash's Terms and Conditions. PasaBar does not collect or store your payment credentials.
6.6 Refunds and Cancellation
- No Refunds: All purchases are final and non-refundable once access to paid features has been granted, which occurs immediately upon payment confirmation.
- Exception — Extended Unavailability: If the App is completely unavailable (excluding scheduled maintenance) for more than seventy-two (72) consecutive hours within your subscription period, you may request a pro-rated credit toward a future subscription. Requests must be submitted to support@pasabar.ph within seven (7) days of the outage.
- Cancellation: Since subscriptions do not auto-renew, no cancellation action is required. Your access expires at the end of your paid period. Account deletion requests can be submitted to support@pasabar.ph.
7. DISCLAIMER OF WARRANTIES; NOT LEGAL ADVICE
7.1 "As Is" Basis
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied.
- AI Limitations: The App may generate AI-assisted feedback that may contain errors, omissions, or outdated legal interpretations. This is NOT a substitute for reading original case decisions and official legal sources.
7.2 No Professional Legal Advice
PASABAR IS A BAR EXAM STUDY TOOL, NOT A LAW FIRM AND NOT AN ACCREDITED REVIEW CENTER.
- The content provided is for educational purposes only and does not constitute legal advice or opinion.
- No Attorney-Client Relationship: Use of the App does not create an attorney-client relationship between you and PasaBar.
- No Guarantee of Results: PasaBar does not warrant or guarantee that use of the App will result in passing the Philippine Bar Examinations. Passing or failing is your sole responsibility.
- Verification: Users MUST verify all information against official jurisprudence. We assume NO LIABILITY for any decisions, actions, or outcomes arising from reliance on App content or AI-generated feedback.
8. LIMITATION OF LIABILITY
8.1 Exclusion of Damages
To the maximum extent permitted by applicable law, in no event shall PasaBar, its operators, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business, or failure to pass the Bar Examinations, arising out of or in connection with your use of the App.
8.2 Liability Cap
In no event shall our total aggregate liability to you for all claims exceed the amount you paid to us for the App during the twelve (12) months immediately preceding the claim.
9. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless PasaBar and its officers, contractors, and affiliates from and against any claims, damages, obligations, losses, liabilities, and expenses (including attorney's fees) arising from:
- Your use of and access to the App;
- Your violation of any term of these Terms of Service;
- Your violation of any third-party right, including any copyright, property, or privacy right; or
- Any claim that your use of the App caused damage to a third party.
10. GOVERNING LAW AND DISPUTE RESOLUTION
10.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines.
10.2 Amicable Settlement
In the event of any dispute, the Parties agree to first attempt to resolve the dispute through good-faith negotiations for a period of at least thirty (30) days before resorting to any judicial proceeding.
10.3 Exclusive Venue
Should the parties fail to reach an amicable settlement, any legal suit, action, or proceeding arising out of or relating to these Terms shall be instituted exclusively in the appropriate courts of Metro Manila, Philippines, to the exclusion of all other courts of equal or competent jurisdiction.
11. TERMINATION
11.1 Right to Terminate
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms (e.g., account sharing, scraping, or circumventing restrictions).
11.2 Effect on Data
Upon termination, your right to use the App will immediately cease. We shall have no obligation to maintain or provide any of your data and may delete all user content from our systems, subject to our retention obligations for payment records under applicable tax law.
12. GENERAL PROVISIONS
12.1 Force Majeure
We shall not be liable for any failure to perform our obligations where such failure results from any cause beyond our reasonable control, including acts of God, typhoons, internet service provider failures, third-party infrastructure outages, or war.
12.2 Severability
If any provision of these Terms is held to be unenforceable, the remaining provisions shall remain in full force and effect.
12.3 Entire Agreement and Incorporation
These Terms of Service, together with the Privacy Policy (available at https://pasabar.ph/privacy), constitute the entire agreement between you and PasaBar regarding the App and supersede all prior agreements. The Privacy Policy is hereby incorporated by reference into these Terms.
13. COMMUNICATIONS
13.1 Service Communications
By creating an account, you agree to receive mandatory service-related messages (e.g., subscription confirmations, expiry reminders, security alerts, changes to Terms). These cannot be opted out of while your account is active.
13.2 Optional Notifications
We may send optional notifications about new features or study tips. You may opt out at any time by contacting support@pasabar.ph or using the unsubscribe link in any email.
